International Dispute Settlement. Galactic Commodities Inc case studies - Essay Example In this discussion, decisions enacted as arbitral awards will be considered; this award means that settlements are implemented after being recorded in an arbitral proceeding. Different issues present themselves in this situation in instances when the law would allow the â€Å"settlement reached in conciliation to be recorded in an enforceable arbitral award† 4. One such issue pertains to form requirements which vary from country to country. An issue in this case is if there is a requirement for clarification for the settlement to be recorded in an award. Should the payment and performance obligations agreed upon be written in much the same way as awards? Or should the tribunals reconceptualize such obligations in the award into others?5 The award based on agreed terms should therefore be clear enough to be enforced without the need for reformulation of interpretation. Recording settlements in an award are based on providing finality and enabling a faster enforcement of the set tlement6. In instances when the parties call for an arbitral tribunal to carry out an award based on agreed terms, risks are often seen and problems of clarity can arise when the parties negotiating settlement are focused on the elements of the settlement, not on the need to fulfill the formal requirements of awards7. An issue may also be seen when the settlement of the parties resolves only some of the issues being forwarded8. This situation can sometimes be easily resolved when a partial award would be given and the other issues are left unresolved. A greater issue results when the settlement includes matters â€Å"which are not within the jurisdiction of the arbitrators, either because such matters fall outside the arbitration agreement or because they have not been submitted to the arbitrators for determination†9. In instances when the settlement resolves matters which are not included in the arbitration agreement, it is clear that the arbitral tribunal does not have cove rage in resolving the issue and rendering awards on the dispute. Another issue which would arise relates to the fact that the settlement gives rights to a party who is not included in the arbitration. This is seen in instances when both or one of the parties belong to a group of corporations where the settled performance must be made or the rights must be exercised by a parent or a sister company10. Awards on the terms agreed upon cannot bind the rights of the third party. The follow-up question in this case is if the arbitral tribunal would still record the settlement in the award. In these instances, the dispute raised before the tribunal is resolved and the arbitration is terminated. If the law allows the tribunal to record the settlement in the award or when the different parties allow the tribunal to record the settlement, the tribunal would now be confused and would be in a dilemma on what to do11. Still another question is if statements shall be possible to record in award fo rms on terms agreed upon. Motives for settlements recorded in awards on agreed terms may not be successfully captured in declaratory statements. But on the other hand, the res judicata effect may already be sufficient reason12. The right to implement awards on agreed terms can call for requests by both parties. Affirmative Action Essay Affirmative action is policies to give special attention or compensatory treatment to members of previously disadvantages group. There is a lot of history and events behind this policy. First, in 1978 the Supreme Court addressed the issue for the first time with the case of Alan Bakke. He was a 31 year old who had been wait-listed for admission by the University of California at Davis. His scores and grades where higher than all the other African Americans so his rejection was declared illegal because they determined his admission by his race. Also, in 1979, the court ruled that a factory and a union could voluntarily adopt a quota system in selecting black workers over more senior white workers for a training program. As a result in 1980, Ronald Reagan, an ardent foe of for affirmative action was finally supported. Following this event, in 1989 the supreme court handed down five civil rights decisions limiting affirmative action programs and making it harder to prove employment discrimination. Lastly, in 1990 Congress passed legislation designed to overrule the Court’s rulings, but President George Bush vetoed it. Then in 1991 Congress made a weaker version of the Civil Rights Act the overruled the Supreme Court rulings which prohibited the use of quotas or affirmative action. The arguments for affirmative action is that there should be a certain number of a race admitted to a college or job. There should be quotas that have to be met with different minority groups. Only the â€Å"superior Caucasian race† should fill the schools or job positions. Everyone else is labeled â€Å"not good enough for the position. † The argument against affirmative action is that it is racist and violates all the civil rights laws we fought for. Everyone should have an equal opportunity to fill the position no matter his or her race, gender, ethnicity, etc. In my opinion, I don’t think affirmative action is needed today. I think it is 100% wrong and racist. Why should my race matter if I get the job or get accepted to a college? It shouldn’t matter, especially if I can work or study just as hard as a Caucasian student. We fought to hard for civil rights in order for this to be acceptable. Reverse discrimination is when a minority is the majority. This mainly happens with groups geared towards that minority. That minority would treat other with affirmative action just like they have probably been treated in the past. For example, college that is historically black will probably accept more African American students compared to any other race. Yes, I believe that reverse discrimination still occurs today. Those minority groups want majority groups to feel what they felt and experience affirmative action. With each candidate I considered his or her grade, scores, and extra curricular activities. I considered their GPA and activities over their SAT/ACT scores because I believe that not everyone is a good test taker. I believe that those tests shouldn’t determine whether you get accepted to a college or not. I don’t think that those scores can tell whether a student is going to succeed in college or not. I think that their GPA and high school grades should determine that. I also think that, that test shouldn’t determine anything because it isn’t fair; it is geared toward Caucasian students. I believe that race should not play any role in whether a student gets accepted, denied, or put on the waitlist. Just because I’m African American and the next student is Caucasian doesn’t mean we are different. At the end of the day both students are applying and attending college to get an education and fulfill their goals and ambitions. Admissions officers should consider how unique a student is and how much they genuinely appreciate education. All colleges should interview their possible applicants because anyone can write anything on a piece of paper. The process is probably really difficult because there are a lot of excellent applicants. Race should not be stated when selecting students for college. I believe that will eliminate affirmative action and other issues. For a college to â€Å"set aside† a certain place for minority groups or to give special treatment to certain groups could mean one of two things in my opinion. First it could mean that they are being racist and believe one group is superior over another. It could also mean that the college is trying to make that student comfortable by giving them people they can relate to. Most minority groups flock together anyway. I do believe that it is wrong for those groups to have special treatment over others because we are all equal. I don’t think colleges engage in this activity today, but they probably have in the past. This probably happened in the past when race played a big factor in everyone’s life. I believe that colleges should make each applicant anonymous when applying so that everyone has an equal and fair chance. Admissions officers should only know the students abilities and accomplishments which will admit them to the school or not. I think that it is very unfair how colleges resort to picking students to attend their schools. I wish this process could change for the better in the future. If a student worked hard in high school and has excellent criteria to attend the school, then why should they be denied over someone whose race is more unique? I believe that we are all equal and we should all get the same treatment no matter our race.

Examining The IS System Of KFC Purpose of the report: The Management of KFC Parramatta has requested an investigation regarding the use of their Information System in relation to their business decision making for competitive advantage and to make recommendations for changes and/or improvements as required. KFC Parramatta is one of the branches of a huge franchise that is famous worldwide. Being a fast food restaurant it faces competition from many other similar restaurants for instance Hungry Jacks, McDonalds, Dominos and every single restaurant be it small or big. Therefore their information system plays a big role in their decision making process and their competitive advantage over their rivals. Knowing how to make improvements in their business using information systems is a major advantage and it is what a the profitability of a business relies on (J.A Senn 1996). Many retail businesses lack an information system making it quite difficult for them to make critical decisions therefore their competitors have a complete advantage over them and in most cases the retail business loses many customers due to the lack of correct information. According to Tutor2u (2010) competitive advantage is an advantage over competitors gained by offering consumers greater value, either by means of low er prices or by providing greater benefits and service that justifies higher prices. Information systems help achieve this because they help the business know what is required and when it is required (Barney 1995) and by using this the business can make decisions such as how many staff to employ during a specific day for instance on Christmas; how much stock is required; what product to stock most; the average business profit during a certain period and its trend i.e. whether the business is going at a profit or lost and such information. The decision making process usually relies on the higher level management not the manager of the branch itself, however without information from the smaller branches it is almost impossible for the top level management to make a decision and thats why a good information system has to exist. Methodology: Taking the above information in mind a research was conducted on KFC Parramatta. A weekly interview was organised with one of the managers, Vinod Patel, mostly on Fridays and Saturdays just outside the restaurant. The information collected was carefully analysed and organised and some of it is presented in this report in the form of graphs and diagrams. Research site: KFC Parramatta is a local restaurant located at Westfield Shopping centre in Parramatta, New South Wales. Being a fast food restaurant, all they sale is food products such as chicken burgers, chicken nuggets, fries and other related products. It is very close to other food courts in the same area and faces a lot of competition from nearby fast food restaurants hance the need for a good IS system. Findings: From the interviews it was found that KFC Parramatta has an information system in place. The information system was used almost in all instances of the business. The following are the key areas where their information system is used: Recording sales data (the product sold, time it was sold , cost of the product, number of products sold and amount sold) Calculating the daily pay for staff members depending on their number of hours. Analysing the performances of the shift supervisor and other staff members ( this is done automatically in the computer where it calculates the total sales and divides it by the number of hours giving a sales per hour figure) Generating the daily, weekly and monthly reports on the performance of the business. It was found that the decisions are made in three levels and as follows: Operational level (store managers): they make the decision on how many staff to employ, assigning jobs to employees, responsible for the daily management of the business and they handle customer complaints. Middle level of management (area managers): they overlook the running of the stores and ensure that nothing is going wrong. Top level of management (executive managers): they are the ones that decide what product to remove from the market, what product to add to the market (as an example the manager illustrated the grilled chicken), at what price to sell it and where to locate new restaurants. Analysis of findings: The sales are done on cash or credit card basis but everything is automated. The cash process is simple and less time consuming as a staff member can easily take cash and give back the required change. The credit card sale basis is a little more time consuming but almost similar to the cash system. Additionally the staff member has to wait till the transaction is approved since the credit card has to be checked to see whether the customer has money in it or not. The order data (the product sold, time it was sold, cost of the product, number of products sold and amount sold) all goes into the server once it is approved and it is stored there. The staff members collecting the data from customers can only input data and once an order is placed modifications to the order can only be done by the authorisation from managers. This acts as a security measure and prevents the staff member from editing any data after it is approved. Another security measure was the existence of a safe to keep all the cash and every staff member is supposed to keep the cash in the safe once it reaches a certain amount. Additionally being located in a shopping mall there are security cameras and even security guards around and this helps keep surveillance around the restaurant. The data stored on the web server can only be accessed by managers of that store (operational level management), the executor management and the administrative level management since they are only ones that have a password needed to log in to access the data. Since the data is all being stored directly on the web server there is a rare chance of the data being inaccurate if any. One of the main reasons for this is because of the long hours they are open. This graph is just one of the few generated by their information system. Without the information system, it would be so hard to analyse data and make a sales graph and therefore it is important that an information system exists. Stock at KFC Parramatta is ordered twice a week on Tuesday and Saturday and this is done manually. The store manager counts the stock manually and orders as required. This leads to time consumption as the store manager has to manually count each and every box. Additionally, during the research it was also found out that during one of the busy days they had run out of stock for fries and chicken because the manager had forgotten to count the stock the day before and failed to place an order. This lead to delays with customer orders since they had to wait get stock from another store nearby. How did this affect the business? Many customers left angrily as they could not withstand the waiting delays. A few of the patient ones waited for an hour before they could get what they ordered. Loss of customers meant loss of profits and even a one hour delay in such a big restaurant causes a major crisis and leads to loss of profits. Located next t o many other similar restaurants, some of the customers even bought from nearby restaurants as they could not withstand delays. This meant the other restaurants gained a slight competitive advantage over them during that period. 2) Another key area is the preparation of the daily roster. The daily roster is prepared manually by the store managers. They do this by calling a team member and confirming their shifts for the next day. The problems associated with this? Firstly, every team member has to be called and this means an added expense. Moreover the roster is not available online and as one incident happened two team members may report for a single shift. Recommendations Figure 3: Example of automatic stock ordering systemKFC Parramatta should get there ordering system automated. They should monitor their stock using barcode scanners, how much goes in and how much goes out. When the stock goes below a certain level the system automatically orders stock. This would help them in getting their stock in time and before the need for it, keeping them on the safer side. According to me below is an example of what I would preferably implement something as follows: Estimated required stock (8 boxes) Current stock (8 boxes) System orders more stock (3 boxes) Stock goes below estimated required level (5 boxes) Additionally they should have a system where the rosters are prepared online and this way team members can see what day their shifts are on, plan their timetable from a convenient location, notify everyone of last minute changes and this way they can prevent many problems. This keeps the other team members aware of their duties and who they work with. Finally they should establish a customer relationship management system (CRM). CRM, or Customer Relationship Management, is a company-wide business strategy designed to reduce costs and increase profitability by solidifying customer satisfaction, loyalty, and advocacy (Reynolds, 2010) .In case a delay happens their customers are loyal to them. This can be established by bringing in a point system for instance buying at KFC Parramatta earns you some points and after you have collected enough points you get to select a meal of your choice and use your points to buy it. Conclusion In conclusion, KFC Parramatta has the potential of being the best restaurant in their area if they slightly modify their current information system. Adapting to some new changes in the information system, an automated ordering process and customer relationship management systems they can gain an absolute competitive advantage over their rivals. Using the information system wisely has lead to it being one of the supreme commanders and with a little more changes they can make decisions more quickly and accurately, and this can lead them to having more customers than other local restaurants. The automated ordering system will ensure they get the goods on time and with customers being loyal to them they can maximise their current profits. (2110 words)

Autobiography of a Face, by Lucy Grealy Essay -- The Search for Unatta

In her memoir, Autobiography of a Face, Lucy Grealy tells the story of how the deformities caused by her cancer forced her into a life of isolation, cruel insults, and unhappiness. Grealy clearly demonstrates how a society that excessively emphasizes female beauty can negatively affect a young girl, especially one with a deformity. Most interpret this story as a way for Grealy to express the pain that she endured because she did not measure up to society’s definition of female beauty, a standard that forces girls into unhealthy habits, plastic surgery, and serious depression. In the afterword of the memoir, Grealy’s friend, Ann Patchett, tries to change this interpretation by saying that Grealy never meant for it to be a story of the hardships she faced as a young girl with a deformity; she simply wished it to be viewed â€Å"as a piece of literature.† (232). However, this short passage takes away from the important message that Grealy expresses in h er memoir: that the unattainable standards of female beauty in society can destroy the joy and livelihood of young girls. Grealy understandably denied this as her reason for writing because, to her, admitting that the story of her life was dominated by her deformity would be like admitting that she had never lived. She frequently explains in her memoir that she longed for physical beauty so that she could finally live without isolation and dejection. To label her memoir a story of loneliness and sorrow would be admitting that she never reached this sense of beauty she so strongly desired. Despite Ann Patchett’s interpretation of the memoir, it should still be seen as a story demonstrating how society’s unreachable standards of beauty can deprecate the lives of young girls, as ... ...t of sexes becomes more equal, young men may begin to develop the habits of young women who try so hard to live up to a perfect standard of beauty. This issue should not and cannot be ignored, and correct acknowledgement of stories like Grealy’s will tighten opportunities for young women to preserve and cherish what really makes them beautiful. Christopher Marlowe Works During The Renaissance

Many major and influential authors emerged during the Renaissance. Among these talented individuals was Christopher Marlowe. Marlowe and his fellow writers of the late sixteenth and early seventeenth centuries, impacted the course of writing, which preceded their life. Their works continue to be read and studied by numerous people, to this day. Christopher Marlowe was a dominant English poet and playwright, who perhaps was William Shakespeare†s most important predecessor in England (Britannica 917). Of all writers in the Elizabethan era, he was perhaps the most dashing, tempestuous, and appealing (Microsoft Encarta). Although Marlowe was considered the most important dramatist, prior to Shakespeare, his entire career as a playwright lasted only six years. Marlowe was born on February 6th, 1564 in Canterbury, England. His father, John Marlowe, was a shoemaker and tanner. His mother, Catherine Author, was the daughter of a clergyman. Marlowe attended Kings School in Canterbury, England. At Kings School, he received a very regimented education, which was considered one of the best available during that time. The school day began and ended with a prayer at six am and five p. m. respectively. In addition to daily instruction in religion and music, they also sang the morning mass in the Cathedral. The boys were allowed to speak solely in Latin, even while at play. He was granted a scholarship, established by Matthew Perry, to attend Corpus Christi College in Cambridge. (Gale Research) After receiving his BA in 1584, he became known as â€Å"Dominus† Marlowe(. At age twenty-one, his motto was â€Å"That which nourishes me, destroys me† (Kunitz 823). This statement foretold and shaped his writing style. From thereafter, many absences from the university were recorded. In 1587, he was allowed to obtain his Masters, only after the Privy Council sent a letter to the university making it very clear that his service to the government had frequently taken him abroad. He left Cambridge after six and a half years of study with the intention of taking holy orders and entering the Anglican Church, as ordained by his scholarship. However, instead he entered the government service, as an agent. In edition, Marlowe became a playwright for the London theatres. As an occasional actor in 1589, Marlowe maintained his role as a regular dramatist for the Lord Admirals Company. He also wrote for The Earl of Nottinghams Companies. Marlowe was often in trouble with the law, and little is known about his life, aside from his writings. He led an adventurous and dissolute life. Earlier playwrights concentrated on comedy, while Marlowe worked on tragedy, and advanced it considerably as a dramatic medium. By uncovering the great possibilities for strength and variety of expression in blank verse, Marlowe helped to establish the verse as the predominant form in the English drama. His first successful play, Tamburlaine the Great, was divided into two sections, parts one and two. It appeared that originally Marlowe intended to only write the first part. However, the popularity of the first part motivated him to create a second part. It was produced at Rose Theatre from 1587 to 1588, and published by R. Jhones in 1590. The ambition-maddened hero, in Tamburlaine the Great, was a shepherd, who desired the crown, luxury and power. However, his conquests were damaged by his absurdity. Tamburlaine marked the birth of the Shakespearean drama. The following lines from Tamburlaine illustrate Marlowe†s opinion of human glory: Nature that fram†d us of four elements Warring within our breasts for regiment, Doth teach us all to have aspiring minds: Our souls, whose faculties can comprehend The wondrous architecture of the world, And measure every wandering planet†s course, Still climbing after knowledge infinite, And always moving as the restless spheres, Wills us to wear ourselves and never rest, That perfect bliss and sole felicity, The sweet fruitition of an earthly crown. (Britannica 917) His masterpiece, The Tragical History of Doctor Faustus, told of a man selling his soul for the price of all knowledge. This appealed to the superstitious Elizabethans. It was produced in 1594 as Dr. Faustus at the Rose Theatre. V. Simmes published The Tragical History of Doctor Faustus in 1604. The following lines from this work show the possible redemption through Christ†s blood: The stars move still, time runs, the clock will strike, The devil will come, and Faustus must be damn†d. O, I†ll leap up to my God! -Who pulls me down? – See, see, where Christ†s blood streams in the firmament! One drop would save my soul, half a drop: ah, my Christ! – Ah, rend not my heart for naming of my Christ! Yet will I call on him: O, spare me, Lucifer! – Where is it now? 'tis gone: and see, where God Stretcheth out his arm, and bends his ireful brows! Mountains and hills, come, come, and fall on me, And hide me from the heavy wrath of God! (Britannica 918) In addition to writing plays, Marlowe also wrote poetry. His major poetic work was Hero and Leander. This was incomplete at his death, the first two sections were completed at his death and the remaining two were finished by George Chapman in 1598, almost five years after Marlowe†s death. Marlowes writing here shows an amazing skill in the management of the narrative decasyllable couplet. No agreement was reached as to the composition date of this poem, but it is ranked as a major work along with Tamburlaine and Faustus. Marlowe began writing poetry and performing plays, when he entered Kings School. His education shaped him to become the genius who first created the Shakespearean blank verse drama. This is why many hailed him as â€Å"The Morning Star†, of the turning point from comedy to drama in England (Marlowe Society Home Page). Marlowe had a dangerous reputation for being â€Å"atheist†; however, he could have had just unorthodox beliefs. He was aquatinted with Sir Walter Raleigh, who was adventurous in his religious beliefs. Marlowe was summoned on May 18th, 1593, to appear before the Privy Council for accounts of â€Å"atheism and immortality†. The charge was a heresy and a most serious crime; the ultimate penalty was burning at the stake. Despite the seriousness of the crime, Marlowe was released bail, however he had to appear at the court daily. Marlowe escaped to Debtford, England. He stayed at Dame Eleanor Bull†s house who hired out rooms and served meals. Marlowe was murdered there on May 30th, 1593, at age 29. The strange circumstances for Marlowes murder in that room in Debtford, have been the subject for many debates. Four men were present at the house on that day Robert Poley was an experienced government agent who carried the Queens most secret letters to and from the courts in Europe. He had arrived from Debtford, straight from The Hague, where he had been on the Queens business. Igram Frizer was the personal servant and business agent of Marlowe†s patron, Thomas Walsingham. Nicholas Skeres often assisted Poley. Poley, Skeres and Frizer were all experienced con men and liars. Also present that day was Christopher Marlowe. Some believe that the cause of his murder was a dispute over a dinner bill. Others believed that Marlowe was murdered because the three men believed that he knew too much about the government. Although the facts surrounding his death are unknown, the end result was Marlowe†s death by stab wounds. Igram Frizer was accused of the murder of Marlowe, however he was pardoned on June 28th, 1593. Marlowe was buried in Debtford on June 1st, 1593. The death of Christopher Marlowe led many scholars to theorize that he faked his death and assumed the name William Shakespeare to escape the Privy Council. Shakespeare was born two months after Marlowe, and he became very popular shortly after the death of Marlowe. Little is known about Shakespeare other then mentioned of his poor education. There is not much evidence of his existence other then baptism paper, and a will left leaving his bed to his wife. There is no mention of his works or manuscripts in his will Marlowe began his career as a poet and playwright towards the end of the Renaissance. The Renaissance was the period from about 1350 to 1600 in which European scholars revived the learning of ancient Greece and Rome. It was a period in European history that saw a renewed interest in the arts. In this time, the middle ages and feudal times were transformed into a society dominated by the arts. It was a time of achievements in the arts and sciences as well as a period when people were deeply concerned with religious issues. Renaissance is a French word meaning â€Å"rebirth†. Scholars reacted against what they saw as the â€Å"dark ages† of medieval Europe and revived the learning of ancient Greece and Rome. Like painting and sculpture, literature expressed the attitudes of the Renaissance. The middle class formed a demanding new audience, which enjoyed dramatic tales rather the comedies. Literature was often written in the common language, but some continued to write in Latin. Literature emphasized religious as well as worldly themes. Invention of printing during the Renaissance greatly increased the number of book available. In the fourteenth century, Europeans learned from Arabs who had previously learned from the Chinese how to make paper from rags and wood pulp. The fifteenth century invention of movable type by Johann Gutenberg also shaped the way literature had previously been written. Gutenberg developed a type of metal that could be used to make movable type. In 1455, the first complete edition of the bible was printed; this started the era of printed books. More and more pieces began to be printed up, and thus decreased the cost of books, making them more available and more popular (Beers 245). Each of Marlowe†s play included a protagonist with single passion that dominated them. The character is doomed to destruction due to their desire of power. He had a background of classical and theological learning. Marlowe â€Å"turned blank verse into a supple instrument for dramatic expression†. (Gale Research). Marlowe worked on tragedy and advanced it immensely. â€Å"Marlowe shows the power to view a tragic hero from more then one angle, achieving a simultaneous vision of grandeur and impotence† (Microsoft Encarta). Renaissance impacted Marlowe due to the desire of the middle class for tragedy rather then comedy, which had previously been the focus of European literature. Marlowe was one of the first writers of drama and tragedy that shaped the history of Europe. Marlowe laid the foundation of tragedy of what would rise up as a new era, known as the Shakespearean Era. Writing was a competition and was taken very seriously by writers including Marlowe. Writers are impacted tremendously by the time period that is taken place during their careers. The Renaissance was a time of new ways of writing and expressing ideas, which impacted the attitudes of the people. The writers changed their style to reflect the time and attitudes. They influence the minds of people to think about their ideas and opinions on a particular subject. Writers can persuade people concerning a topic by revealing the positive and negative aspects of it. Marlowe was an influential and powerful writer. It was unfortunate that his career was cut short. He had a very promising career, but his own decision to become a government agent endangered his career and stopped him from becoming an more popular and productive playwright.

Education in Our lives Essay

What do you think education means to society? What does education mean? An education is commonly defined as a process of learning and obtaining knowledge. Many problems can occur that can prevent an education to people such as religion, culture, tradition, income and where you live or come from. Those can create different assumptions of someone’s educational background. The education for society can be different, due to the fact that various types of education plus learning methods and assumptions affect me and others in many different ways. An important key role in my life by far is education, because so far it has given me a different perspective of life. A well-known Greek Philosopher named Plato once said that the direction in which education starts a man will determine his future in life. He literally means the type of education we chose to follow or have leads to us becoming that. So far in my journey of life it has opened and shown my eyes to a lot to see in this world. Education has given me the chance to learn and discover new things around me; in addition it has taught me to believe about life. Education has made me who I am today, and will have a huge impact in my future to come, because it will determine how I will live. It has given me a picture or sense on what I can achieve and do in life. My education started at a very young age, just like most people start theirs. My first mentors and teachers were not from elementary school, but they were my own people that raised me from home. The education I received to this day has made me a better decision maker about life’s big questions. Nelson Mandela best said that education is the most powerful weapon which can be used to change the world. What Nelson Mandela is trying to mean is that education is the answer to move forward in life. I totally agree with Mandela on that. In some places, people don’t see education has being important or don’t care about obtaining a great educational knowledge. An example could be a high school graduate not wanting to extend his education to get a degree from college or a university, which can bring good things in his life. According to former Secretary of Education of the U.S William Bennett he states American 12th graders rank 19th out of 21 industrialized countries in mathematics achievement and 16th out of 21 nations in science. Our advanced physics students rank last. There are various types of  education and learning, and each affects me and other people differently. Location plays a big role in the type of education we are getting or will get. For example, a person living in a 3rd world country isn’t likely going to receive the same education as let’s say someone in the United States. Another example could be if a student goes to school at an urban city like New York and other student was to go at a small town with few people living there, their education plus learning would be different. The school teachers also affect many students differently. Many people don’t realize that all teachers do not teach or explain something the same way, they teach differently. Let’s say a student goes to their local school for about five years, then moves across the country and attends a school there, his educational learning would be affected. According to Jenifer Steele a researcher for Rand Education she mentions in an article titled â€Å"Teacher Matter: Understanding Teachers’ Impact on Student Achievement† that when it comes to student performance on reading and mathematical tests, a school teacher is estimated to have two to three times the impact of any other school resource. She also states that effective teachers are best identified by their performance, not by their background or experience. A student’s own will to learn, will also deeply affect his or hers education. If a student has the opportunity to go to school or even college, but doesn’t have the will to learn won’t have a good educational background. On the other hand, a student also has the opportunity to go to school/college, plus has the will to learn will have a better education than the student who does not. There are many factors of this, but a major one takes place in the classroom. Many students dislike school, and some may even drop out of it. Everyone’s educational background is different. Everyone has different assumptions that tell us or inform about our educational or learning experiences. Some assumptions tell us good about education some tell us bad things. For example, an assumption from the University of North Carolina in Charlotte about educational learning is that people at all different ages have the potential to learn, with some learning quicker than others. Age may or may not affect a person’s reaction of learning, and individuals vary in way they like to learn. This could be true, but at the same time it could have potentially to be false as well.  Another example, in the classroom the teacher facilitates learning by incorporating students’ experience, observation of others, and personal ideal and feelings. Exposure to many different behavior models and attitudes help students to make actions and ideas that will help in meeting their own educational goals. This is labeled an assumption because some believe in this way of teaching students, while some teachers do not. We all have different kinds of assumption about school education; my assumption of education is if students put more effort in addition focus more on academics, and less time on other things then they will succeed in getting an education. My assumptions about education and learning do in fact compare and contrast to what I am currently experiencing in college. An example of an assumption is that students do not need much guidance from the instructor, which was mentioned in the Seven Deadly Assumptions about Students article from Point Loma Nazarene University. My assumption that contrasts their assumption is that I truly believe in that some students may need lots help or assistance from the instructor. My assumption compares to what I’m experiencing in college, due to the fact that I get a lot of help from my instructors and tutors. A second assumption from the article is that students will put together the content that they are expected to learn, by themselves after class. I do not agree with this because some students may not know how to start applying it. When I need to learn something in class I make sure I am able to apply the material by myself after class. If for some reason I cannot apply the material alone I ask the instructors or tutors for help. A third one from the same article is that students should do their work during the class session. I totally agree with this one due to the fact that students learn better around their classmates. In college I do my own work during the class because I can ask the instructor or my fellow classmates’ questions about the work. In conclusion, an education is mostly defined as a process of learning and obtaining knowledge.
